Digital Millennium Copyright Act (DMCA) Policy

RTXKeeda (“us,” “we,” or “our”) respects the intellectual property rights of others and expects our users to do the same. It is our policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

If you believe that your copyrighted work has been infringed upon on our website, please notify our designated copyright agent in writing with the following information:

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
  3. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  4. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that you may be liable for damages, including court costs and attorneys’ fees, if you materially misrepresent that content on our website is infringing your copyright.

Upon receiving a proper notification of alleged copyright infringement, we will remove or disable access to the allegedly infringing material promptly and notify the alleged infringer of your claim. We will also advise the alleged infringer of the DMCA Counter Notification procedure described below.

Counter Notification: If you believe that material you posted on the website was removed or access to it was disabled by mistake or misidentification, you may file a counter notification with us (a “Counter Notice”) by providing our designated copyright agent with the following information:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located (or if you are outside of the United States, that you consent to jurisdiction of any judicial district in which the service provider may be found), and that you will accept service of process from the person or company who provided the original DMCA notification.
  4. A physical or electronic signature of the subscriber or user.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.

After we receive your Counter Notice, we will forward it to the party who submitted the original DMCA Notice and will inform that party that we will replace the removed material or cease disabling access to it within ten business days. Unless our designated copyright agent receives notice from the party who submitted the original DMCA Notice that they have filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on our website, we will replace or restore access to the material within ten to fourteen business days after our designated copyright agent receives the Counter Notice, provided that we have not received notice from the original complaining party that an action has been filed seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on our website.
